Handling of personal information and answer data

This "Personal Information and Copyright Handling Policy" (hereinafter referred to as "this Policy") defines the relationship between Gively Inc. (hereinafter referred to as "our company") and those (hereinafter referred to as "candidates/students") who take the programming questions (hereinafter referred to as "programming questions and materials") provided on our service "Track" (hereinafter referred to as "this service"). In order to take the programming questions and materials, you will need to agree to this Policy, so please read it carefully before agreeing.

1. Handling of personal information

  • Our handling of personal information of test takers and students will be in accordance with the provisions of our "Privacy Policy ( https://givery.co.jp/privacy-policy/ )", and test takers and students agree that our company will handle their personal information in accordance with these provisions.
  • Our company may provide the information, data, etc. (including personal information) provided to our company by examinees/students to users of this service (those who have entered into a service agreement for this service with our company) who have granted the examinees/students the right to take programming questions and study materials, and examinees/students agree to this in advance.
  • Our company may, at its discretion, use and disclose information and data provided to us by candidates and students as statistical information in a form that does not identify individuals, and candidates and students shall not object to this.

2. Handling of answer data

  • When sending or otherwise providing answers to programming problems or study materials, candidates/students shall transfer to our company, free of charge, all rights relating to the copyrighted works (including the rights stipulated in Articles 27 and 28 of the Copyright Act) that they provide through our services.
  • Candidates and students agree not to exercise their moral rights against our company or any person designated by our company.

3. Acquisition of keystroke information

  • When candidates/students take programming questions and study materials, our company may obtain keystroke information entered from the keyboard (hereinafter referred to as "Keystroke Information"), and candidates/students agree to this in advance.
  • Our company may view and use this keystroke information in a format that does not identify the individual who is the subject of the personal information, to the extent necessary for the development of fraud detection technology and the provision, maintenance, and improvement of the Service, and candidates and students agree to this in advance.

4. Changes to this Policy

Our company reserves the right to change these Terms and Conditions at its discretion without prior notice. Candidates and students must confirm the latest version of these Terms and Conditions when using the Service, and by using the Service, they are deemed to have agreed to any changes to these Terms and Conditions. Furthermore, any rights and obligations currently arising under these Terms and Conditions will not be affected by any changes to these Terms and Conditions unless otherwise specified in the revised Terms and Conditions.
